LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT for KRU NAT MUAY THAI LLC

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

This Liability Waiver, Release of Claims, and Assumption of Risk Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Kru Nat Muay Thai LLC, its owners, officers, instructors, contractors, employees, agents, and affiliates (collectively, the “Gym”).

1. ASSUMPTION OF RISK

I understand that participation in Muay Thai, martial arts training, strength and conditioning, sparring, pad work, use of equipment, and related activities (collectively, the “Activities”) involves inherent risks. These risks include, but are not limited to:

·         Serious bodily injury, including cuts, bruises, fractures, concussions, and permanent disability

·         Physical contact with other participants

·         Slips, falls, or equipment-related injuries

·         Cardiovascular strain or medical emergencies

I voluntarily assume all risks, known and unknown, associated with participation in the Activities.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and covenant not to sue the Gym from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by me while participating in the Activities, whether caused by negligence or otherwise.

I shall not hold the Gym or any of its affiliates responsible for any claim to injury, pain, or undue process for training or other activity that occurs outside of the premises. Staff genuinely associated with the Gym will be clearly posted within the Gym. The gym is not responsible for any members who may misrepresent themselves as affiliates of the gym. 

3. INDEMNIFICATION

I agree to indemnify and hold harmless the Gym and its affiliates (partners, contractors, landlord, property manager) from any loss, liability, damage, or costs, including attorney’s fees, that may arise due to my participation in the Activities, whether caused by my actions or otherwise. This also includes Activities that occur external to the physical facility of the Gym, including, but not limited to, competitions, fights, at home training sessions, etc.

4. MEDICAL FITNESS

I certify that I am physically fit to participate in the Activities and have no medical conditions that would prevent safe participation. I agree to inform the Gym of any relevant medical conditions.

I consent to emergency medical intervention if necessary and agree to be responsible for any costs incurred. This can include, but is not limited to, the use of CPR by certified staff or individuals, and transportation to a medical facility by ambulance or other emergency vehicle. 

5. RULES AND CONDUCT

I agree to follow all gym rules, instructor guidance, and safety protocols. I understand that failure to do so may result in my removal from participation without reason or refund. All owners, trainers, and affiliated of the Gym may ask any member or guest to leave the premises at any time. 

I agree to follow the dress code of the gym which requires Muay Thai shorts and a t-shirt or modest tank top. I understand that I will be asked to change or purchase appropriate clothing sold on-site if I arrive out of dress code.

For your safety, socks are not permitted while training.

6. USE OF EQUIPMENT AND FACILITIES

I understand that improper use of equipment or facilities may result in injury. I agree to use all equipment as instructed and at my own risk.

I understand that I may not remove any equipment from the gym for personal use outside of the premises. 

Neither the Gym, nor its affiliates, are responsible for damaged or lost personal property. This includes property stored in a locker behind a customer provided lock. 

7. PHOTO AND VIDEO RELEASE

I grant permission to the Gym to use photographs or videos of me taken during training for promotional purposes, including social media, website, and marketing materials, without compensation.

Should I not wish for my likeness to be used in promotional materials, I must notify the Gym in writing.

8. MINORS

If the Participant is under 18 years of age, a parent or legal guardian must sign below. The parent/guardian agrees to all terms of this Agreement on behalf of the minor.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

10. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11. ACKNOWLEDGMENT OF UNDERSTANDING

I have read this Agreement, fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. I acknowledge that I am signing this Agreement freely and voluntarily.
